The Las Vegas Route 91 Harvest Massacre

On October 1, 2017, country music star Jason Aldean was on stage performing the final night of the Route 91 Harvest music festival in Las Vegas, Nevada. The Festival is an annual three-day outdoor event held at the south end of the Las Vegas Strip near Mandalay Bay Hotel and Casino.

During the ten-minute period 10:05 – 10:15 p.m., a guest at the Mandalay Bay hotel opened fire from the 32nd floor of his hotel room onto the unsuspecting crowd of more than 22,000 concertgoers. The gunman fired more than 1,000 rounds of ammunition.

The Immense Loss

Fifty-eight innocent people were killed, which included 36 women and 22 men, ranging in age from 20 to 67, with an average age of 38. Seven individuals were from Nevada, 33 were from California, 14 were from other states, and 4 were from Canada.

An additional 851 people were physically injured, 422 with gunshot wounds.

Thousands have suffered long-term emotional harm, including post-traumatic stress disorder.

The incident is the deadliest mass shooting in United States history.

Hotel Negligence

In the course of our investigation, we have discovered numerous acts of fault against the companies responsible for safety at the hotel. These acts include:

  • The hotel failed to provide adequate staff to patrol the hotel to reasonably discover and prevent the gunman from performing prohibited and illegal acts, even after the gunman raised suspicion by bringing in and out of the hotel 19 pieces of luggage, and had a "Do Not Disturb" sign on his suite for more than 24 hours.
  • The hotel failed to implement reasonable security measures to address, monitor, identify, and prevent the gunman from bringing into the hotel 23 assault rifles and 6,000 rounds of ammunition through the hotel, up a service elevator, and into his room over multiple days.
  • The hotel failed to reasonably discover and prevent the gunman from barricading an emergency exit.
  • The hotel failed to reasonably discover and prevent the gunman from installing surveillance equipment in public areas.
  • The hotel failed to reasonably discover and prevent the gunman from breaking his hotel windows.
  • The hotel failed to timely respond or act after first learning that an active shooter was on the 32nd floor.

Concert Site Negligence

We also have discovered several acts of fault against the companies responsible for safety at the concert. These acts include:

  • There were not sufficient entrances and exits to allow the attendees to escape in an emergency situation.
  • There was not permanent signage clearly showing entrances and exits for emergency evacuation.
  • There was not an accessible communication system for public use when ordinary communications were unavailable (such as, emergency sirens).
  • There was not a reasonable emergency evacuation plan to allow concert attendees to evacuate the premises in the event of an emergency.
  • There was not adequately trained or competent personnel on duty, including security guards and event staff, at the time of the attack to respond adequately to the shooting, such as implementing emergency evacuation procedures.

Who is Responsible to Compensate Those Who Lost a Loved One or were Injured

Based upon our investigation to date, the following companies share responsibility for the Route 91 Harvest massacre, and we are going to make sure they are held accountable for the October 1 shooting: (1) MGM Resorts International; (2) Mandalay Corp.; (3) Mandalay Resort Group, Inc.; (4) MGM Resorts Festival Grounds, LLC; (5) Live Nation Entertainment, Inc.; (6) Live Nation Group d/b/a One Nation Group, LLC; and (7) Contemporary Services Corporation, Inc.

MGM Resorts International owned Mandalay Corp. and Mandalay Resort Group, Inc. at the time of the shooting. MGM Resorts Festival Grounds was the owner of the property where the Route 91 Harvest Music Festival was being held. Live Nation Entertainment, Inc. and Live Nation Group produced and promoted the concert. Contemporary Services Corporation was responsible for the onsite security the night of the shooting.
